Senate Commerce panel weighs federal pre-emption issues around breach notification

Lawmakers on a Senate Commerce subcommittee on Tuesday debated the issue of pre-empting state data breach notification laws, as security researchers detailed the potential benefits and pitfalls of a national standard.

The question of how a federal law would pre-empt state laws has been one of the most difficult to resolve in the years-long effort to craft a national breach-notification standard.
