HHS preparing to issue request for information on civil penalties for data security violations

The Department of Health and Human Services will soon formally request information to guide its implementation of a near-decade-old law that gives it the power to seek civil penalties for privacy or security violations, highlighting the growing challenge of navigating disparate state laws and determining what constitutes “harm.”
