Legal scholars warn FCC's proposed privacy rules would fail courtroom challenge

A group of prominent legal scholars and economists argue the Federal Communications Commission's proposed privacy rules for internet service providers are unconstitutional, and suggest that the proposal would not survive a legal challenge.

“By treating ISPs differently from other other online entities, the proposed rules would create a discriminatory, speaker-based regime,” writes the group in a letter to the FCC. “Such a regime is presumptively invalid and subject to strict scrutiny, which the proposed rules could not withstand,” concludes...
