Court decision could boost scrutiny of industry cybersecurity

Companies will face more regulatory and judicial pressure to improve their cybersecurity following this week’s decision by the 3rd Circuit Court of Appeals affirming the Federal Trade Commission’s authority to levy enforcement actions against businesses with insufficient defenses against hackers, according to attorneys and privacy advocates.

“With the backing of the circuit court, we expect the FTC to double down on its cybersecurity efforts,” the law firm Wiley Rein said in a client alert issued Tuesday.
