NATO study eyes legal hurdles to cyber investigations

NATO’s cybersecurity center has published a new legal study on the challenges of investigating cyber incidents in circumstances where the data needed for the investigation is located extraterritorially. Data being located across national borders is increasingly impacting responding to and investigating cyber incidents, the report says.

The report, “Accessing Extraterritorially Located Data: Options for States,” looks at mechanisms of Mutual Legal Assistance (MLA) and other established means for international cooperation in accessing such data. The study urges national governments...
