LabMD is due next week to appeal landmark FTC data-breach order

The medical testing company LabMD is expected next week to “petition for reconsideration” a Federal Trade Commission order last month that found the company failed to adequately protect the personal information of its customers.

The order – which overturned an administrative law judge's rejection of the FTC's enforcement action against the company – is seen as dramatically expanding the definition of what constitutes “harm” in demonstrating inadequate security measures.
